PLEASE TAKE THE TIME TO READ OUR CONSULTATION POLICIES BEFORE MAKING AN APPOINTMENT. BY BOOKING A CONSULTATION YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO THE TERMS FOR THE CONSULTATION TYPE YOU ARE BOOKING.

Visa Sidekick Consultation & Scheduled Phone Call Terms and Conditions

COMMON TERMS

The following are the common terms and conditions that apply to any and all consultation or phone call types that we have available for booking.

Individual consultation or phone call types may have additional terms specific to them. These will be specified at the end of this page, or on the booking page.

Payment

Where there is a fee payable for a consultation, the total amount must be paid in full at the commencement of the consultation.

You should have your bank card details readily available at the time of your scheduled call. You may use a different card to that for which you paid the booking fee.

In order to secure your appointment, you may be required to pay a $20 non-refundable administrative booking fee. This fee is an administrative fee only, so will not be held in our Trust Account.

Once your consultation has been booked, you will receive an email confirming the details of your appointment.

At times we may hand out promotional codes that, when applied, lower the total cost of the consultation. To redeem the offer the promotional code must be entered when filling in the booking details prior to payment and booking confirmation. The discount does not apply to the non-refundable booking fee. No further discounts will apply and discount codes cannot be used in conjunction with any other offer. Offers are available only for a limited time only and can end without notice.

We use Stripe to facilitate online payments through our website and booking system. All payment fees charged by Stripe are included in the overall cost of the consultation. Stripe may vault your card details in their records for making payments at a later date. When Stripe vaults your card details, we do not have access to the full card details, but we are able to charge the fee at the commencement of the consultation. You should refer to Stripe’s policies for more information on card vaults.

Consultation

At the time of your consultation, we will call you using the number you provided in your booking. You may like to provide an alternate number we can reach you on just in case. Be sure you are comfortable and in a quiet place where you can talk and hear us easily.

If you are overseas, we will contact your using WhatsApp. Be sure to have WhatsApp downloaded and ready to use prior to your consultation.

The length of time shown, at the time of booking, for each appointment is the maximum time we allow for that appointment type. Enquiries will not generally take the full allowable time. The fee for an appointment is a fixed fee, not time based, so no partial refunds will be owed in the case of a consultation that does not require the maximum time.

Priority Service

If you require advice from us urgently (within 12 hours of contacting us or out of hours), we charge AUD500.00. Please contact us by phone (1300 858 995), our contact form, or email us at hello@visasidekick.com.au to arrange this priority consultation service. Due to the immediate nature of this appointment type your consultation fee will be charged in full at the time of booking.

Rescheduling or Cancelling Your Appointment

You may use the online scheduler to reschedule your appointment up to 6 hours prior to your appointment. However, if you do this more than twice, we may charge a further administrative fee for subsequent changes.

As our consultations are in high demand, our booking fee is not refundable in the event of cancellation.

We understand that sometimes things happen that are beyond your control, so we do take exceptional circumstances into consideration and will consider these on a case-by-case basis. Any refund will be at the absolute discretion of Visa Sidekick. If the booking fee is refunded to you, it will be refunded less the Stripe payment charges.

We reserve the right to refuse or cancel an appointment booking for reasons such as if the details we have requested in the booking details have not been filled in correctly or if the query is something we cannot help with. For example, if your query is about a visa type we do not assist with or about a visa for a country other than Australia.

If you are unsure whether your query is a type we can help with you are welcome to email us before booking to ask (hello@visasidekick.com.au). We will not be able to assess your visa options in such emails but we can advise if it something that would be suitable to discuss during a consultation. If your appointment is cancelled by us, we may issue a credit to your bank card (or other applicable payment account) in the amount of the charge less Stripe payment fees. We will attempt to contact you if your appointment is cancelled or if additional information is required to accept your appointment.

Lateness and No Shows

It is in your interests to ensure that you are on time for your appointment. If you are running late, please call or email and let us know. If you are more than 15 minutes late, you will not be able to spend the full allocated time with us and we may ask you to schedule a subsequent appointment, at your own cost.

If you don’t attend your appointment, the administrative booking fee will not be refundable or transferrable.

Additional Documents & Information

You are encouraged to provide as many details about your immigration status and circumstances as possible prior to your consultation to assist our immigration specialists in being prepared to answer all your questions and provide you with advice. You may upload any relevant documents when making the booking or emailing them to us at hello@visasidekick.com.au (be sure your email includes details that match your booking details). If you are interested in any skilled/work based visas you should provide an up to date CV prior to your consultation time.

If we receive documentation at least 24 hours prior to a scheduled consultation, we will review these in preparation for your consultation.

If you do not provide the documentation prior to a consultation, and we require it to advise you, we may direct you to book a follow up consultation at your own cost.

VEVO Check

A VEVO check is a check that can be done online using your passport details to check your current visa details, including the expiry date. This can be very helpful in a consultation. If you are not confident you know the exact details of the visa you currently hold we would suggest doing a VEVO check yourself online prior to your consultation and having the details handy or emailing them to us (hello@visasidekick.com.au). Alternatively, when booking the consultation you can upload a copy of your passport and either you can consent to us doing a VEVO check for you prior to your consultation or we can do the check during your consultation. We must receive the consent from the person whose passport is provided. If you are booking on behalf of somebody else, you must not provide consent on their behalf unless you have their authority to.

Purpose of Initial Consultation & Strategy Discussion

The purpose of our initial consultation is to assess whether you have any visa options that would suit your goals for your stay in Australia. Most often people are seeking to remain in Australia permanently, but this is not always the case. Booking in a consultation does not guarantee that you will eligible for any visa type. We will assess whether, based on your current circumstances and the migration law that applies at the time of consultation, if you have any suitable Australian visa options. The discussion and advice will be limited to the migration law at the time of the consultation.

A consultation does not create an ongoing lawyer-client relationship and does not bind us to update you if the migration law changes after your consultation.

We may discuss with you, at our discretion, visa options that may be available to you in future, but we do not provide a full assessment and advice for hypothetical scenarios that are based on multiple variables. An example of a hypothetical scenario would be if a person were wanting to apply for a work visa based on qualifications and/or work experience they had not yet commenced or obtained and with an employer they had not yet found.

During the consultation, we will assess the visa options for one person and will touch on any dependents that may be included in any available visa options. For couples (de facto or spousal), to assess both partners’ options individually (eg to see who has the best options) this may be done by selecting the add-on when booking. Any extra charges for this add-on will be visible in the booking system.

Please Note: We do not offer services in relation to Protection or Refugee visas. These will not be assessed during your consultation.

Getting the most out of your consultation

Consultations work best if we can speak directly with the prospective visa applicant or, in the case of a partner visa, their partner sponsor. If you are booking a consultation on behalf of someone else, please provide details of this in the booking details. We also strongly suggest providing the contact details for the other person or including them in the call.

Crediting Consultation Fees towards Full-Service Immigration Assistance Options: Terms and Conditions

These terms and conditions apply to any person who has a paid consultation with Visa Sidekick.

Terms Used

  • Consultation Fee refers to the base cost for an initial consultation and strategy discussion, including the booking fee. This does not include any add-ons or additional cost for complex matters. The consultation fee is inclusive of Goods and Services Tax (GST), where applicable.

  • Full-Service Assistance refers to a comprehensive service where our immigration lawyers assist clients from the beginning to the end of their immigration matter. This includes, but is not limited to, providing advice on legal requirements, reviewing and advising on documentation, lodging applications, monitoring applications, and providing advice on application decisions.

  • Eligible Full Service Assistance means Full-Service Assistance options with a minimum cost threshold of over $2000 excluding GST.

  • Engaged Our Services a person is only considered to have engaged our services after the initial retainer amount specified in the relevant cost agreement is received in our trust account; and the cost agreement has been signed by the person and returned to us.

  • Client in these terms means a person who has engaged our services or intends to engage our services

Criteria For Credit to Apply

A client is eligible to receive a credit towards Eligible Full-Service Assistance if they have engaged our services within 28 days from the day of their own initial consultation.

The credit amount applied towards Eligible Full-Service Assistance will be equal to the base consultation fee (including the booking fee), less any discounts applied to the consultation, and excluding any add-ons such as assessments for a partner's options or the complex circumstances add-on.

The credit will be automatically offered when clients request cost agreements to be sent within 28 days of their consultation. It will be specified in the cost agreement – if it is not, you may not be eligible. You should contact us before signing our cost agreement.

To activate the credit, clients must engage our services within the 28-day period. Engagement entails:

  • Payment of the retainer amount specified in the cost agreement to our practice trust account; and

  • Signing and returning the cost agreement to us.

If these conditions are not met, the credit will not be applied.

It is the responsibility of the client to allow enough time for the cost agreement to be drafted and issued, and then signed and returned by them, as well as the funds to be received into our trust account. Cost agreements are generally issued within 24 hours of written request for them, unless approval on costs is required from a third party, such as an employer sponsor, prior to being issued.

Exclusions

The consultation fee credit may be forfeited in the event of early termination of the matter as per the terms of the cost agreement or a change to the scope of services outlined in the cost agreement, regardless of which party initiates the termination or modification.

The credit will not be applied if we are not engaged to assist within the 28-day timeframe.

Other Terms

Payment terms for Full-Service Assistance will be specified in the cost agreement to engage our services.

Details regarding additional fees, payment schedules, and accepted payment methods will also be outlined in the cost agreement.

The procedure for cancellations and any applicable refunds for Full-Service Assistance will be detailed in the cost agreement.

These terms and conditions may be modified or terminated by us at any time without prior notice.

Clients must adhere to all legal obligations and requirements related to their immigration applications, as well as the terms specified in the cost agreement they enter with us.

These terms and conditions pertain solely to the crediting of consultation fees for clients proceeding with Full-Service Assistance. If clients engage our services, additional cost agreements and our regular terms and policies, including consultation terms, will continue to apply.

 FREE Partner Visa Consultation Policy (2023 Valentine’s Day Promo)

For a limited time only we are offering consultations to discuss partner related visas for NO FEE, here on in referred to as the 'promotional consultation'. Bookings must be MADE & SECURED before 11.59pm AEDT on 14 Feb 2023 to be eligible.

Promotional Consultations – Additional Terms

The total cost of this promotional consultation is $0 and the consultation is limited to a maximum of 30 minutes.

Promotional consultations are offered on a first come first served basis and availability and times are limited to those in the booking calendar. No further discounts will apply and cannot be used in conjunction with any other offer.

Only one free promotional consultation may be booked per couple (couple being the entity of the prospective applicant and partner/sponsor) whether booked by a member of the couple or by another person on behalf of the couple.

Promotional consultations are available only for a limited time only and can end without notice.

Promotional consultations are limited to exploring basic eligibility for partner visas or partner related visas only. Specifically, the following visa types:

  • Subclass 309 and/or Subclass 100 Offshore Partner Visas

  • Subclass 820 and/or Subclass 801 Onshore Partner Visas

  • Subclass 300 Prospective Marriage Visas

  • Subclass 461 NZ Family Member Visa (for partners and/or children only)

  • Applying to be added to your partners subclass 482 temporary work visa (where your partner already holds the subclass 482 visa)

  • Applying to be added to your partners subclass 500 student visa (where your partner already holds the subclass 500 student visa)

We will only discuss and advise on those of the above that are relevant to you and your circumstances.

During the promotional consultation, we will not advise in-depth on:

  • Applications that have already been lodged by you or another lawyer/agent;

  • Health waivers and health issues that may warrant a health waiver

  • Character issues that may impact on the application

  • Persons who are currently unlawful or on bridging visas

If any of the above apply to you, you may be asked to book a paid consultation. To save time you may like to book a paid consultation to start rather than booking a promotional consultation.

Booking Promotional Consultations

In order to secure your appointment, you must fill in all the requested details and confirm your booking online. All details requested must be entered completely and correctly. We reserve the right to cancel any appointments already booked if any or some of the requested details have not been sufficiently provided.

Once your consultation has been booked, you will receive an email confirming the details of your appointment.

Consultation

Promotional consultations are available only for a limited time only and can end without notice.

Promotional consultations are limited to exploring basic eligibility and visa issues relevant to the caller and their immediate family’s circumstances only. The call is for a length of 20 minutes maximum and this may not be long enough to discuss all your migration issues, eligibility and questions in full.

In the event that the call time is insufficient to answer all the caller’s questions, or conclude a full assessment of all visa options they are interested in, the caller may choose to book in a paid Initial Consultation and Strategy Discussion.

The length of the promotional consultation, will not allow sufficient time to advise in-depth on:

  • Applications that have already been lodged by you or another lawyer/agent;

  • Health waivers and health issues that may warrant a health waiver

  • Character issues that may impact on the application

  • Persons who are currently unlawful or on bridging visas

In the unlikely event that we call you later than scheduled, where additional time is required at the end of the scheduled time, we will endeavour to make up for the number of minutes were late - either by continuing on beyond the scheduled end of the call or scheduling a follow up time.

You are encouraged to provide as many details about your immigration status and circumstances as possible prior to your consultation to assist our immigration specialists in being prepared to answer all your questions and provide you with advice. If you are interested in any skilled/work based visas you should provide an up to date CV prior to your consultation time.

Callers are encouraged to provide any documentation at the time of booking. We will review any documentation provided at the time of booking prior to the phone call. However due to the short nature of this phone call, we will not be able to review any documents and provide further advice after the call. For a post appointment review of documentation you will be directed to book a a follow up Consultation for a fee.

 Application Checking Report - Initial Phone Call T&Cs

If you are interested in an Application Check for your partner visa application, the first step is to book in a quick phone call with us to make sure the Application Check is suitable for your application. There is NO FEE for this phone call and NO OBLIGATIONS.

We truly just don’t want to waste anyone’s time or money, if it isn’t the right fit.

Promotional Consultations – Additional Terms

The total cost of the promotional consultation is $0 and the call is limited to a maximum of 10 minutes.

It is expected and assumed that all questions in the online booking form are answered fully, completely and accurately when scheduling the call. The answers to these questions may be relied upon during the call as well as in any Application Check, if you choose to proceed with one.

The Initial Calls are offered on a first come first served basis and availability and times are limited to those in the booking calendar. No further discounts will apply and cannot be used in conjunction with any other offer.

Only one free call may be booked per couple (couple being the entity of the prospective applicant and partner/sponsor) whether booked by a member of the couple or by another person on behalf of the couple.

This call types is limited to discussing the basic nature and complexity of your partner visa application and visa strategy only so far as to assess whether the Application Check would be suitable. Application Checks are best suited to straight forward applications with simple visa strategies.

They are not suited to applications that are high risk, have complex elements and/or complicated visa strategies. These types of visa applications are best suited to more involved assistance, such as full service assistance, so the application can be closely monitored to avoid mistakes.

This phone call is not to assess your eligibility for the partner visa application. It is expected that you you will have already done this yourself. The Application Check itself may pick up issues with eligibility and this would be included in the final report if you chose to go ahead with it after the call.

The Application Checks can be used for those who are lodging applications despite significant health and/or character issues, but the Application Check is not designed to assess, assist with or monitor those issues.

During this appointment, we will not advise in-depth on any complex matters, including but not limited to the following:

  • Applications that have already been lodged by you or another lawyer/agent;

  • Health waivers and health issues that may warrant a health waiver

  • Character issues that may impact on the application

  • Persons who are currently unlawful or on bridging visas

  • Which type of partner visa is best for you to apply for

  • Which type of visa is best for you to apply for

Booking

In order to secure your appointment, you must fill in all the requested details and confirm your booking online. All details requested must be entered completely and correctly. We reserve the right to cancel any appointments already booked if any or some of the requested details have not been sufficiently provided.

Once your call has been booked, you will receive an email confirming the details of your appointment.

Appointment

At the time of your consultation, we will call you using the number you provided in your booking. You may like to provide an alternate number we can reach you on just in case. Be sure you are comfortable and in a quiet place where you can talk and hear us easily.

If you are overseas, we will contact your using WhatsApp. Please have WhatsApp downloaded and ready to use prior to your consultation.

Rescheduling or Cancelling Your Appointment

You may use the online scheduler to reschedule your appointment up to 6 hours prior to your appointment. However, if you do this more than twice, we may charge an administrative fee of $20 for subsequent changes or cancel the call.

We understand that sometimes things happen that are beyond your control, so we do take exceptional circumstances into consideration and will consider these on a case-by-case basis.

We reserve the right to refuse or cancel an appointment booking for reasons such as where the details we have request in the booking details have not been filled in correctly; where the query is related to a visa type other than a partner related visa; or if the query is something we cannot help with.

We will attempt to contact you if your appointment is cancelled or if additional information is required to accept your appointment.

Lateness and No Shows

It is in your interests to ensure that you are on time for your appointment. If you are late, please call or email and let us know. Due to the short nature of the calls, if you are late it is likely that there will not be enough time and we may ask you to schedule a subsequent appointment, if necessary, at your own cost.

If you don’t attend your appointment, the Initial Call will be forfeighted.

Additional Documents & Information

As this call type is to assess suitablility for the Application Checking Service only, and is not for receiving advice, there should be no need to provide additional documentation. Where you feel other documentation is relevant to your matter, you may find a paid consultation type is more suited to answer your queries in full.

Legal Relationship & Advice During the Call

An Initial Call for an Application Check service is simply a courtesy to check the service is right for your type of application. No information provided during the call will be legal advice and booking in or taking the Initial Call does not create an ongoing lawyer-client relationship. We are not under any obligation to update you if the migration law changes after your Call or follow up with you about your application unless you actively engage us for formal legal services and/or assistance after the call.
