New Flexibility for 457, 482, and 494 Visa Holders: Changes from 1 July 2024
The Department has announced significant changes to visa conditions 8107, 8607, and 8608, effective from 1 July 2024. These changes will impact Subclass 457, 482, and 494 visa holders, offering more flexibility if you stop working with your sponsoring employer.
Key Changes
Extended Timeframes:
You will now have up to 180 days at a time, or a maximum of 365 days in total across your entire visa grant period, to find a new sponsor, apply for a different visa, or arrange to leave Australia.
This extension allows you to support yourself by working for other employers, including in occupations not listed in your most recently approved sponsorship nomination.
Work Restrictions:
You must cease work with your sponsoring employer before commencing work with another employer.
While working for your existing sponsor, you must remain in your nominated occupation.
You must not perform work that is inconsistent with any licence or registration requirements for your nominated occupation.
Obligations for Sponsors:
Sponsors must notify the Department of any changes in the situation within 28 days, including if you resign or if your sponsorship ceases.
Applicability:
These changes apply to both existing visa holders and those granted a visa on or after 1 July 2024.
Any periods you stopped working for your sponsor before 1 July 2024 will not count towards the new time periods.
Considerations for Permanent Residency (PR)
While these changes provide greater flexibility, it's crucial to consider the long-term impacts on your path to Permanent Residency (PR). For example, if you are aiming for the Subclass 186 visa in the Transitional stream, maximising your time on the Subclass 482 visa with your future sponsor is essential to avoid additional visa costs.
Conclusion
These changes are designed to provide more flexibility and support for visa holders navigating their employment landscape in Australia. Make sure to stay informed and compliant with all visa conditions to ensure a smooth transition.
